California Nonresident Tuition Exemption "AB-540"

Assembly Bill 540 became part of the California Education Code (Section 68130.5) when it was signed by then Governor Davis in 2001. The purpose of the California Nonresident Tuition Exemption for eligible California high school graduates is to allow eligible students without lawful immigration status to pay in-state fees at California public colleges and universities.

Eligibility Requirements

  1. Student must have attended a high school in California for three or more years.
  2. Student must have graduated from a California high school or attained a California high school diploma equivalent.
  3. Student does not have lawful immigration status, so they must file an affidavit with the college or university stating that the student will file an application as soon as the student is eligible to do so.
